Changes to the Housing Grants Regeneration and Construction Act
1996 come into force on 1 October. The new provisions about notices
are particularly important. Unwary employers and main contractors
may find that, if they are not careful, the sum that their
contractor or subcontractor applies for becomes the “sum due” and
can be claimed in an adjudication. Meanwhile, contractors and
subcontractors need to know how to use the new rules to assist
their cashflow.
There are also changes to the law on the right to suspend work,
clauses that provide for payment on the issue of certificates under
other contracts, payments due on contractor insolvencies and
adjudication.
This seminar is intended to be an informal and practical review
of these changes, with discussion and questions as we go along. It
will be led by specialist lawyers from Weightmans’ national
Construction and Engineering team.
