Reasonable adjustments: Scottish & Southern Energy plc v
Mackay
In the EAT’s decision of Scottish &
Southern Energy plc v Mackay, the EAT confirmed that a failure to
investigate adjustments is not in itself a breach of the DDA.
However it could render a sickness dismissal unfair. It may
also cause evidential difficulties in defending the DDA case.

Redundancy consultation: UK Coal Mining Ltd v National Union of
Mineworkers EAT/0397/06R – Implications for employers
An employer should usually carry out
collective consultation on the reasons for the business closure.
