Race discrimination – British Medical Association v Chaudhary, Court of Appeal, 2007 EWCA Civ 788

The Court overturned a record damages award of £814,877 and provided useful guidance on the indirect discrimination ‘pool for comparison,’ victimisation and loss of chance. Age discrimination – could compulsory retirement be unlawful?

Employers from both private and public sectors will have to decide on whether to continue to retire staff at the default retirement age. Paul McFarlane, an Associate at Weightmans, London reviews the ECJ decision of Palacios de la Villa v Cortefiel Servicios SA (C-411/05) and the recent EAT decision in Johns v. Solent SD Limited (not yet reported) and considers the implications for UK age discrimination law in the future.
