Employment issues for retailers

As from 1 July 2007, smoking in all enclosed public areas and workplaces will be outlawed under the Health Act 2006. Jamie Campbell looks at some of the practical issues for employers and retailers when the smoking ban takes effect.

Lost in translation

The recent case of Vagharia –v- LPC 2006 raises interesting points on the need for employers to be aware of their duty to train and provide written instructions under the Provision and Use of Work Equipment Regulations 1998 [PUWER]. Ivor Long discusses the need for written instructions under PUWER.

Ladder falls

This highlights another case considering the ambit of the Provision and Use of Work Equipment Regulations 1998 (PUWER).   We look at a House of Lords judgment which serves to further reinforce the wide ranging and onerous nature of the Regulations.

Adjusting for disability

Section 6 of the Disability Discrimination Act 1995 states that employers have to take reasonable steps (or make adjustments) if any “arrangements” they make put a disabled person at a substantial disadvantage compared to someone who is not disabled.  We look at a Court of Appeal case about whether employers have to make adjustments to a job if a disabled applicant has not actually applied for it.
