Construction

Advice, guidance and support for all parties involved in the construction industry on both non-contentious and contentious issues, including PFI and PPP.

The range of legal issues affecting the construction industry are many and varied, as are the related commercial risks that apply, particularly on larger contracts. The legal skills required in advising the organisations involved therefore need to be supported by a high level of commercial awareness.

Weightmans’ nationwide Construction team meet these twin demands with a unique combination of skills and experience. The pragmatic and commercial approach we take is shaped by the cumulative experience of our expert lawyers, who have either worked in-house in the construction industry or are dual qualified.

The range of projects we advise on is a reflection of the depth of our practice. We advise a cross-section of the construction and engineering community, in both the private and public sectors, including PFI work.

As a client in either sector, we can provide you with advice and support on every area of responsibility and liability, particularly on contract details and on key areas of risk and compliance, such as CDM Regulations and Health and Safety Legislation.

We specialise in drafting and interpreting industry-wide contracts such as JCT, ICE, NEC and PPC2000, and advising on the meaning and effect of warranties, bonds and deeds of novation. We also have extensive experience in the resolution of construction contract claims by means of adjudication, mediation and litigation.

As part of our comprehensive service in risk and insurance issues, we conduct contract audits to identify risk exposure and provide specialist advice on insurance coverage and project-specific insurance. In this context, we deal with claims arising from the use of defective plant and equipment, with particular reference to contracts, risk assessments and method statements.
