Fraudulent claims, even when successfully defended, can result in significant expenditure of time and money for the organisations affected, and their insurers. The most effective legal services seek not only to minimise these costs but also to pursue false claimants through further enforcement proceedings.

Weightmans’ Fraud team takes a direct and highly focused approach to dealing with fraudulent claims. We believe in devising a strategy for each case at the earliest stage, in order to avoid unnecessary legal costs and to bring proceedings to a conclusion as rapidly as possible. We do not settle cases on the door of the court.

We advise on all aspects of fraud, including staged and contrived accidents, phantom passenger claims, minor impact claims, serial claimants and fabricated claims for damages. As well as case handling, our team has an expert methodology for the detection of fraud, utilising various databases as well as a dedicated panel of external investigators.

As a client, you will also benefit from our consultancy services, which analyse your processes and procedures and ensure that they comply with relevant legislation, such as the Data Protection Act, duties of confidentiality and the Civil Procedure Rules.

What distinguishes our service most is our ability to go beyond the successful detection and repudiation of fraud. As an ethical matter, we believe in bringing fraudsters to book once a claim has been defeated, therefore we provide further advice and support and all means necessary to do this, such as pursuing recoveries and enforcement proceedings, preparing files for criminal prosecution and/or professional misconduct.
