Social Services covers a vast area of responsibility involving both public and private sector bodies. There are numerous legal complexities, and the issues that arise often attract wide public attention and concern. Dealing with these matters therefore requires a high level of legal and diplomatic skills and a deep understanding of the work that goes on.

Weightmans’ specialist Social Services team has extensive expertise and experience in this field. We provide advice and guidance on a wide range of issues encompassing mental health, human rights, community and continuing care, protection of vulnerable adults, nearest relative displacement proceedings, home closure cases, eligibility criteria cases and judicial reviews. We also provide representation at inquests and during criminal investigations.

We understand the sensitivities involved in these matters and are experienced in advising on policy matters and disputes arising from service users. We also handle data protection and freedom of information queries, and our general healthcare expertise gives us a special insight into joint working arrangements from both sides of the fence.

We have been involved in a number of reported cases where we have achieved successful outcomes for our clients. Examples include capacity to consent to a TV documentary, force-feeding of a detained juvenile with learning disabilities, and confidentiality and disclosure of a Mental Health Review Tribunal decision to a potential victim.

We provide a comprehensive, proactive service that goes beyond incident response and routine case management. This includes providing advice, support and training on legislation and government guidance for those most directly involved, both in the public and private sector. We also deliver Approved Social Worker training and regularly lecture to a wide range of audiences at national level.
