At Weightmans, we undertake more civil claims work for police forces than any other law firm, and we’ve been involved in some of the most significant and high profile cases that have impacted on the police service …

Our specialist expertise covers:

Public liability claims – false imprisonment or assault

Ranging from high profile, complex and sensitive claims which require a significant commitment of time and resources, to more straightforward cases which need to be handled proportionately and cost effectively.

Public liability claims – malicious prosecution, misfeasance in public office or malicious procurement

Including claims arising from criminal investigations with the potential for significant compensation and reputational damage, as well as challenges to prosecutions arising from public order incidents and the execution of search warrants.

Judicial Review

Including claims arising from wide-ranging challenges to operational policing policies. We can deal with claims from the letter of claim stage and substantive proceedings. We have the team and resources available to meet the tight timeframes required to respond.

Human Rights Act and negligence

We have particular expertise in the Human Rights Act, including claims for breach of Articles 2, 5, 8, 10, 11 and more recently Article 3.  We successfully represented the chief constables in the leading cases of Van Colle v Chief Constable of Hertfordshire Police and Smith v Chief Constable of Sussex Police [2008] UKHL 50.

Claims under the Equality Act

Our expertise includes claims for discrimination arising from race, gender and sexual orientation, from the investigation of allegations and completion of Equality Act questionnaires, through to preparing and defending claims to trial before lay assessors.

Inquests (including Article 2 Inquests)

We have represented chief constables and officers at the Coroner’s Court at hearings ranging from one day to several weeks, and have specialist expertise in firearms inquests and anonymity applications.

Magistrates Court work

We regularly undertake work in the magistrate’s court for applications made under the proceeds of crime legislation, and for sexual offender orders, neighbourhood policing orders, football banning orders, and others.

Employer liability claims

Our wealth of experience defending employer liability claims includes claims arising from both operational policing and training, from trips and slips to harassment, bullying and industrial diseases. These range from small claims to permanent loss of employment and serious injury.

Public liability

We also have considerable expertise advising on personal injury claims regarding members of the public, or damage to property belonging to members of the public.

Our specialist RTA team handles low value personal injury claims through the Ministry of Justice  portal, as well as technical claims, fraudulent claims and high value catastrophic claims.
