Public and private sector education establishments operate within a unique legislative framework. Interaction among employers, governors, staff, students and pupils gives rise to a complex variety of responsibilities and risks, all requiring sensitive and effective handling.

Weightmans' Education team has developed a comprehensive understanding of the issues affecting the education sector, based on many years’ experience and an in-depth understanding of the legal, social and political background.

We regularly represent schools, colleges, universities and governors in employers’ and public liability cases, and defend claims arising from workplace accidents and incidents occurring in the classroom, on the sports field, in the gym and on school trips.

As an individual or organisation involved in delivering education services, we aim to develop a partnering relationship with you, helping you to protect your position and achieve your objectives as cost-effectively as possible. Before we begin that relationship, we assign an experienced, dedicated legal adviser to gain a full understanding of your particular needs and concerns.

On a practical level, we advise on risk management issues, HSE investigations, defended criminal prosecutions, human rights issues and policy matters such as exclusion, admission and appeals. 

We also advise on terms and conditions of school contracts and issues involving disputes with parents.  Other areas of expertise include special educational needs, governance and data protection. To aid prevention and help avoid problems, we provide regular bespoke legal bulletins and provide training on INSET days.

In addition to issues affecting the provision of education and damages claims, we also advise on employment matters, commercial disputes, property transactions, financial services regulation, site redevelopment and banking agreements.
