An overview of the Enterprise Act and the particular challenges for reinsurers 

The Enterprise Act 2016 came into force on 4 May 2017 and introduced an implied term into all insurance contracts that claims must be paid within a “reasonable time”.  The operation of this implied term is expected to give rise to particular problems within the subscription market and to reinsurers.  For example:

  • What is the position of a follower in circumstances where there has been late payment of a claim by the lead underwriter?
  • What happens if the reinsurer assumes claims control and there is a delayed payment:
    • Would the insured be able to claim direct against the reinsurer?   
    • What is the reinsured’s position vis a vis the reinsurer?
