Our next Breakfast Bite session will address one of the growth niche areas in personal injury claims, proving a concern for insurers due to issues relating to identification, the nature and extent of expert evidence and complexity in refuting causation. These claims can give rise to a potentially significant financial exposure in respect of both costs and damages. They can primarily be encountered by handlers at all levels, so an ability to identify them as early as possible is critical to the implementation of appropriate strategy and tactics.

The presentation will seek to:

  • Provide a brief overview of the structure and function of the brain;
  • Provide a synopsis of the mechanics, diagnosis, classification and consequences of brain injuries;
  • Highlight what differentiates subtle TBI’s;
  • Provide a brief overview of the legal landscape and patterns in claims;
  • Provide practical guidance from a defendant perspective as to:
    • Identification
    • Investigations/Causation
    • Expert selection
