The Insurance Act came into force in August 2016.  Now that it has had time to bed in, how are we seeing its provisions interpreted and applied in the real world – and what practical pointers emerge?

Alex Marler considers, including:

  • Case law – what if any guidance do we have from the courts so far?
  • Policy wordings – how have they been amended to reflect the Act’s provisions; is the effect of the changes always clear; are insurers making (or insureds and brokers demanding) and accompanying changes; contracting out?
  • Behaviour (of insurers, insureds and brokers) – does everyone understand their obligations; is disclosure / fair presentation being handled effectively; the importance of clarity and record-keeping.
  • Some potential misconceptions and pitfalls – including remedies that do remain strict, circumstances.
  • Remedies – how are the new remedies being invoked in practice; what hurdles must be overcome to do so; how can they be pre-empted and mitigated?
