Weightmans successfully defends NHS trust in shoulder dystocia case

Weightmans was instructed by NHS Resolution on the successful defence of Taylor v Chesterfield Hospital NHS Foundation Trust [2019] EWHC 1048 (QB). The case was heard at the Royal Courts of Justice in February 2019, with judgment handed down this week. The claimant sought damages in excess of £1 million for brachial plexus injury arising from her birth in 1992. The claim was dismissed.

Weightmans associate Tom Briggs was the case handler, and Vicky Morris was supervising partner. Farrah Mauladad of Crown Office Chambers was instructed counsel for the defendant.
