Kelly has over 14 years' experience property litigation experience, practising in Leeds for the majority of her career. She deals with all contentious aspects of commercial, residential and agricultural property matters. Kelly has acted for a diverse range of clients, including local authorities, the NHS, landed estates, universities and some very well known retail and developer businesses.
She acts for both landlords and tenants in possession, termination, service charge, forfeiture, breach of covenant, dilapidations and renewal actions. She also advised third parties eg LPA Receivers, banks and guarantors in relation to risks, rights and obligations pertaining to third party ownership and possession. Kelly also has extensive experience in real property matters, such as nuisance, trespass, nuisance, rights of way, right to light and general easements. She has represented clients in a number of forums, including mediation, arbitration, County Court, High Court and First Tier Tribunal (property chamber).
Her recent experience includes contesting an invalid break notice in the County Court, defending a tenant in relation to permission sought by the landlord for the operation to quit of an agricultural notice to quit in the First Tier Tribunal (property chamber), representing the seller of a large area of land for development in relation to a claim for misrepresentation (rights of way over the land) and seeking an injunction in the High Court for a landlord in relation to breach of lease covenant.
