Biography

Rosalind joined Weightmans in 2022 and has over 20 years of experience in the resolution of disputes arising from clinical negligence and personal injury for both the NHS and a wide range of insurers. She has acted for a large range of health professionals which include, in addition to doctors and midwives, optometrists, osteopaths, physiotherapists, sonographers and dentists. She has also acted for care homes in the private sector in a wide range of claims, including those arising from inappropriate behaviour of both staff and other patients. Currently, she advises on and manages a wide range of clinical claims involving catastrophic injury with an emphasis on those involving brain injury sustained at birth or in the neonatal period and also following neurological or spinal injury. She has considerable experience of claims involving maternal and neonatal death and also of those arising for alleged failures to provide appropriate psychiatric care where patients have sustained severe injuries following failed attempts at suicide. Rosalind has extensive experience of claims with periodical payment orders and also claims made under the Human Rights Act.

Recent instructions include a birth related injury pleaded at £40m, a claim arising from maternal and unborn child deaths with a possible COVID-19 complication and a complex claim arising from alleged failures to diagnose a cerebral spinal fluid leak and subdural haemorrhage. Rosalind is dealing with numerous multi-party claims involving GPs.

Other previous experience includes advising insurers on catastrophic personal injury claims and a major utility company on a range of issues including escapes of sewerage and clean water – see reported case Nicholson v Thames Water Utilities Ltd [2014] EWCH 4249.
