It has long been established that employers can be vicariously liable for acts of discrimination between co-workers when these arise during the course of employment, subject to the employer’s duty to take all reasonable steps to prevent such acts. Whilst preventing acts of discrimination in the workplaces can raise a variety of challenges, employers do have a fairly high degree of control over co-workers. What can create a much greater challenge, however, is taking steps to prevent the harassment of staff by third parties such as customers, hotel guests and restaurant clients, over whom there is far less control.
Since October 2024, employers have had a duty to take reasonable steps to prevent third-party sexual harassment. As from October 2026, this duty will be extended to preventing third party harassment in respect of all the remaining protected characteristics such as race, religion, sexual orientation and disability.
