Maintaining High Professional Standards in the Modern NHS / Upholding Professional Standards in Wales Investigations

MHPS Investigation

An UPSW or MHPS investigation by an NHS employer can have serious consequences for a doctor or dentist’s career. MHPS/UPSW investigations can cover concerns relating to conduct, behaviour, capability, and interactions with colleagues. Investigations can not only result in disciplinary sanctions or action in respect of capability, but can also lead to regulatory referrals, safeguarding or sometimes the police.

We are experts in the representation of registrants in disciplinary investigations and hearings; our highly experienced team have been at the forefront of this area of law for decades. We have represented registrants in some of the most high-profile challenges to MHPS processes including cases in the High Court, the Court of Appeal and the Supreme Court.

Early expert advice can make all the difference. Often the key to early resolution is clear and sensitive case presentation at the initial stages. We provide pragmatic, goal-focussed advice aimed at resolving investigations as quickly and as efficiently as possible. Our experts will support, guide and advise you throughout the process.

We defend our clients robustly. However, we always consider the broader context. Where a strategy is more appropriately structured around remediation and insight, we have substantial experience advising practitioners in formulating remediation plans and negotiating agreed outcomes with NHS employers.
