Thomas Murphy



Tom is an associate working within both the restructuring & insolvency and commercial dispute resolution teams in Liverpool. Tom trained and qualified at Weightmans and has over 20 years' expertise as a commercial litigator advising on all aspects of corporate and personal insolvency, restructuring, commercial disputes and complex debt recovery.

Tom's main clients are insolvency practitioners in their capacity as liquidators, administrators, LPA/fixed charge receivers, and trustees in bankruptcy, although Tom also advises banks and other lenders, creditors and debtors including individuals, partnerships and directors of insolvent companies.

Tom handles a wide variety of contentious and non-contentious insolvency related matters, debt recovery and commercial disputes including:


Appointments of administrators, pre pack administrations, LPA and fixed charge receiverships, liquidations, security reviews, validity of appointment reviews, sale agreements, retention of title claims, recovery of and setting aside antecedent transactions (at undervalue, defrauding creditors and preferences), claims against directors (wrongful/fraudulent trading and misfeasance), applications to summon parties to appear (for delivery of property, books, papers, records or information), validation applications, applications for possession and sale, COMI issues, income payments agreements and orders, realisation of after-acquired property, suspension of discharge from bankruptcy, director disqualification, disclaiming onerous property, statutory demands, applications to set aside statutory demands, bankruptcy/winding up petitions, disputed petitions, urgent injunctive relief and annulment applications.

Commercial dispute resolution

Issuing court proceedings, defended county court and high court litigation, appeals, contractual disputes (including breach of contract and repayment issues), urgent injunctive relief, company/shareholder and partnership disputes, contentious probate, enforcement of judgments and costs orders obtained in England and Wales and foreign jurisdiction.

Tom also has advocacy experience, engages in ADR and has attended successful mediations with clients.
