Rachael Barthel works in our Court of Protection Team at our Leeds Office.
Rachael is a Court of Protection Solicitor who works on a variety of client facing matters. Rachael works with and assists individuals who lack the requisite mental capacity to manage their Property and Financial Affairs on their own, for example through serious acquired brain injury or Alzheimer’s Disease. Rachael’s matters include Applications to the Court of Protection of varying complexity, for Property and Financial Deputyship for lay and professional Deputies (including Trust Corporations).
Rachael’s work also includes the administration of Professional Deputyships which involves the day-to-day management and support of a Protected Person’s Financial and Property Affairs. This includes Applications to the Court of Protection to purchase and sell properties on behalf of clients. Rachael works closely with the Protected Person, their loved ones, the Court of Protection and the Office of the Public Guardian to ensure the Protected Person’s needs are met and to ensure the smooth running of their Property and Financial Affairs. Rachael often works with individuals who have ongoing or settled personal injury matters and is well versed in liaising with Personal Injury Solicitors and assisting with Litigation Support.
Rachael advises on Personal Injury Trusts and can take the individual through this step by step. Rachael’s work further includes drafting and administration of Lasting Powers of Attorney for Property and Financial Affairs where professionals are appointed as Attorneys. Rachael additionally has previous experience in Contentious Court of Protection, Wills and Trusts and is able to assist on complex applications to the Court of Protection including Statutory Will and Gifting Applications.
