With high employer costs and risks associated with participation in public sector defined benefit schemes, we are assisting many clients with changes to their DB pension arrangements. Where there is contractual right to the scheme, the main method used is to obtain employee/union consent to the change. Where consent is not provided, dismissal with notice and an offer of immediate re-engagement is often used as a method for implementing the pension change.
The Employment Rights Bill (as drafted) will severely limit the availability of dismissal and re-engagement. This will in-turn have implications for such pension change projects. The change is scheduled to come into force in October 2026.
